Effective date: September 19, 2026. These Terms of Service ("Terms") govern your access to and use of Futureley websites, accounts, customer portal, and services.
By creating an account, placing an order, paying an invoice, or using Futureley services, you agree to these Terms and our Privacy Policy. If you use Futureley on behalf of a business, you represent that you have authority to bind that business. If you do not agree, do not use the services.
Futureley may provide, among other things:
Futureley uses third-party providers (payment processors, registrars, hosting/infrastructure, email, and others) to deliver parts of these services. Futureley does not claim to directly operate every underlying network, data center, or registrar system used to fulfill an order.
Website and managed-service work is performed according to the scope described in your order, quote, plan, or written confirmation. Changes outside that scope may require additional fees or a new agreement. Customer-provided content, access credentials, approvals, and timely feedback may be required to meet delivery timelines. Unless otherwise agreed in writing, Futureley may use subcontractors or specialist partners to perform portions of the work.
Hosting plans include the features described at purchase (for example storage, SSL, and backup cadence where listed). Futureley may use third-party hosting or infrastructure providers to run hosted environments. You remain responsible for your application code, plugins, credentials you control, and compliance with acceptable-use rules. Futureley does not publish a formal uptime SLA on this page unless a separate written agreement states one.
Domain search, registration, renewal, transfer, and DNS changes are subject to registrar policies, ICANN/registry rules where applicable, and the terms of Futureley's domain partners (for example ResellerClub when configured). Domain availability and pricing can change until registration is successfully completed with the registrar. Domain registration and renewal fees paid to registries/registrars are generally non-refundable once submitted, even if you later cancel related Futureley services. You are responsible for renewing domains on time or enabling auto-renew where offered and paid for; expiration can cause loss of the domain.
Access to Futureley software features (including the customer portal and owner tools, where provided) is licensed for your internal business use during an active paid or authorized period. You may not reverse engineer, abuse APIs, or resell platform access except as expressly permitted.
Live card charges occur only when Futureley's payment gates and processor configuration are enabled for your environment. Until live charges are enabled, checkout may create order/invoice records without capturing live payment.
You may request cancellation of Futureley-managed recurring services by emailing support@futureley.com or through portal support where available. Cancellation timing depends on the billing cycle and the service type; domain registrations already submitted to a registrar are separate (see Domains). You remain responsible for charges incurred before cancellation takes effect.
Futureley does not offer a blanket money-back guarantee. Refund eligibility is evaluated case by case based on the service type, work already performed, and third-party costs:

Futureley may suspend or terminate accounts or services for non-payment, suspected fraud, legal risk, security risk, or material violation of these Terms or acceptable-use rules, with notice when reasonably practicable. You may stop using services and request closure subject to outstanding balances and third-party domain obligations.
You may not use Futureley services to:
You retain ownership of your pre-existing content and trademarks. You grant Futureley a license to host, process, and display that content as needed to provide the services. Futureley retains ownership of its platform, software, designs it creates as reusable frameworks (except final deliverables assigned in a separate written agreement), documentation, and branding. Feedback you provide may be used to improve Futureley without obligation to you.
Third-party products (registrars, payment processors, hosting vendors, plugins, analytics, etc.) are governed by their own terms. Futureley is not responsible for outages, policy changes, or data practices of third parties beyond Futureley's reasonable coordination role.
Futureley aims to keep services available but does not warrant uninterrupted or error-free operation. Backup features, where included in a plan, reduce but do not eliminate risk of data loss. You should maintain independent copies of critical content and credentials. Restore assistance may be subject to plan limits or additional fees.
EXCEPT AS EXPRESSLY STATED IN A WRITTEN AGREEMENT, FUTURELEY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURELEY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURELEY AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. FUTURELEY'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICES IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID TO FUTURELEY FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THAT PERIOD (EXCLUDING AMOUNTS PASSED THROUGH TO THIRD-PARTY REGISTRARS OR SIMILAR PROVIDERS). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
You agree to defend and indemnify Futureley against claims arising from your content, your unlawful use of the services, your violation of these Terms, or your infringement of third-party rights, except to the extent caused by Futureley's willful misconduct.
Futureley may update services, features, and these Terms. Material Term updates will be posted on this page with a revised effective date. Continued use after the effective date constitutes acceptance of updated Terms for ongoing services, except where additional consent is required by law.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, unless a different governing law is required by a mandatory consumer statute that cannot be waived. Courts located in Florida shall have exclusive jurisdiction for disputes arising from these Terms, subject to applicable law.
